General terms and conditions of business
of the company Haus- und Gartenservice Alkhalif, Sigehardstraße 33a, 64653 Lorsch

1. Scope

These general terms and conditions apply to all business relationships between the Alkhalif home and garden service company and its customers.

2 offers

The Alkhalif home and garden service company provides the customer with non-binding offers. Since the prices can change until implementation, the Alkhalif House and Garden Service company reserves the right to adjust them until implementation. For offers with a longer period
Implementation period, adjustments are also possible during the implementation phase. In any case, the customer will be informed of the change and will have the opportunity to withdraw from the contract.

3. Execution of the work

The Alkhalif home and garden service company registers with customers in advance to carry out the work. The customer is responsible for coordinating with the neighbors who will be affected by the work. This applies in particular to the necessary entry onto other people's properties.

The tasks are carried out according to customer requirements. The customer is responsible for obtaining the necessary permits. He is also responsible for informing himself about the legal framework and only assigning the Alkhalif House and Garden Service company those tasks to carry out that comply with the legal regulations.

Removing weeds is primarily an aesthetic measure. A period of time for which the cultivated area remains weed-free cannot be derived. Parts of the plant may remain in the soil.

Plant pruning measures are carried out according to the generally applicable rules. However, if plants do not grow as expected after cutting or even die, no liability will be accepted.

There is no guarantee that plants will grow. Plants are planted according to generally applicable rules. Since further care is carried out by the customer, there is no warranty here.

In exceptional cases and after a separate and express agreement, a growth guarantee can be agreed. However, this requires that the Alkhalif home and garden service company is commissioned for all maintenance work, especially cutting and watering the plants in the first 2 years, and that the use of the plants by the client does not harm the development of the plants.

If the company requires electricity or water to carry out the work, the customer must provide this free of charge.

4. Damage

The risk of damage to partially carried out or completed work before acceptance by third parties, force majeure or weather influences lies with the customer. The work required to repair such damage will be invoiced separately by Haus- und Gartenservice Alkhalif. This also applies to flat-rate offers/invoices.

When trees are felled, gardening work or other gardening work occurs, land damage or damage to fencing or plants regularly occurs. The customer is advised to remove objects in the area of the work. House and Garden Service is not liable for
Damage to the areas mentioned.

The Alkhalif House and Garden Service company can be commissioned separately to repair field damage or other damage. The repair of this damage is under no circumstances included in a flat rate offer and will be carried out on an hourly basis or by separate agreement.

The customer must inform Haus- und Gartenservice Alkhalif of known dangers when carrying out the work before the work begins. These can be, for example, lines or cables in the work area. House and Garden Service Alkhalif assumes no liability for damage resulting from missing or incorrect information.

5. Delivery/execution period

Since the work is mostly dependent on the weather (frost, wetness, temperatures, ...), execution dates can be postponed. House and Garden Service Alkhalif cannot therefore be liable for postponements of execution dates.

6. Acceptance

If a customer does not request formal acceptance immediately after the work has been completed, the work will be deemed to be carried out with the  Invoice payment as accepted, but no later than 14 days after completion of the work. Completion is deemed to be the  Notice of completion or invoicing.

7. Warranty / correction of defects

The company Haus- und Gartenservice Alkhalif guarantees that the work was carried out properly at the time of acceptance in accordance with the recognized rules of technology and is suitable for the intended use.

No liability is assumed for any materials supplied by the customer.

If the customer claims defects, he must immediately inform Haus- und Gartenservice Alkhalif in writing. The company Haus und Gartenservice Alkhalif reserves the right to remedy the defects by making improvements. If it is not possible to rectify the deficiencies, a reduction in the invoice amount or a corresponding refund will be sought to settle the matter.

8. Invoicing

The invoice amount must be paid no later than 14 days after delivery of the invoice. If a customer defaults on payment, Reminder fees of 2 euros (for private customers) or 35 euros (for commercial customers) for the first reminder, a further 2 euros or 35 euros for each additional reminder.
